Welcome to My Sports ID Card! These Terms of Service (“Terms”) govern your access to and use of the My Sports ID Card website, mobile applications, and all related services, features, content, and products (collectively, the “Platform”), owned and operated by My Sports ID Card (“My Sports ID Card,” “we,” “us,” or “our”).
By accessing, browsing, registering for an account, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our NIL Compliance Policy, all of which are incorporated by reference herein. If you do not agree to these Terms, you may not access or use the Platform.
IMPORTANT NOTICE: These Terms contain provisions that govern how disputes between you and My Sports ID Card are resolved, including a mandatory arbitration provision and a waiver of class action rights. Please read these sections carefully.
2.1. Minimum Age: You must be at least 13 years old to create an account on the Platform. If you are under 13, a parent or legal guardian must create and manage your account on your behalf, providing verifiable consent as required by our Privacy Policy and COPPA. By creating an account, you represent and warrant that you meet this age requirement.
2.2. Account Creation: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided is inaccurate, not current, or incomplete.
2.3. Account Security: You are solely responsible for maintaining the confidentiality of your account login credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. My Sports ID Card will not be liable for any loss or damage arising from your failure to comply with this section.
My Sports ID Card provides a digital platform enabling users to:
4.1. Compliance is Your Responsibility: You acknowledge and agree that you are solely responsible for understanding, adhering to, and complying with all applicable Name, Image, and Likeness (NIL) laws, regulations, guidelines, and policies related to your NIL activities. This includes, but is not limited to: * Federal, State, and Local Laws: Specific NIL laws in your state of residence, your institution’s state, and any other relevant jurisdictions. * NCAA Rules: All current and future NCAA (National Collegiate Athletic Association) rules, including any interim policies or outcomes from legal settlements (e.g., House v. NCAA settlement) that impact college athletes’ NIL rights and revenue sharing. * Institutional Policies: Your specific university, college, high school, or athletic association’s NIL policies, which may vary and impose additional restrictions. * Youth & High School Athletic Associations: Rules and guidelines from entities like the NFHS (National Federation of State High School Associations) and state-specific high school athletic associations regarding NIL for high school and younger athletes.
4.2. No Pay-for-Play or Inducement: You agree that any compensation received for NIL activities facilitated through the Platform must be for actual services rendered at fair market value. Such compensation cannot be: * Conditioned on athletic performance (e.g., points scored, games won, team success). * Used as an inducement to enroll at, attend, or transfer to a particular educational institution. * A substitute for athletic aid or scholarships (unless expressly permitted and regulated by NCAA and institutional rules regarding direct payments to athletes, which are evolving).
4.3. Use of Intellectual Property: You represent and warrant that any NIL activity you engage in on the Platform, including content you create, sell, or promote, does not infringe upon the intellectual property rights of any third party. This specifically includes, but is not limited to: * Institutional Marks: You are prohibited from using the trademarks, logos, copyrights, uniforms, or other intellectual property of your educational institution, team, or athletic association in your NIL activities on the Platform, unless you have obtained explicit, written permission and a compliant license from that institution/entity. My Sports ID Card is not responsible for securing such permissions on your behalf. * Third-Party Content: You must have all necessary rights, licenses, and permissions to use any third-party copyrighted material, trademarks, or other intellectual property in your content.
4.4. Prohibited NIL Activities: You agree not to engage in NIL activities on the Platform that promote or are associated with: * Gambling, sports betting, or casinos * Alcohol or tobacco products (including e-cigarettes/vaping) * Cannabis or illicit drugs * Adult entertainment or sexually explicit content * Weapons, firearms, or ammunition * Banned substances (as defined by athletic organizations like NCAA, USADA) * Hate speech, discrimination, or illegal activities.
4.5. Disclosure Requirements: You understand that certain NIL activities may require disclosure to your educational institution, conference, or athletic association, or may be subject to state-specific reporting requirements. You are solely responsible for fulfilling any and all such disclosure obligations in a timely and accurate manner. My Sports ID Card may provide tools to assist in documenting your NIL activities for self-reporting, but it is not responsible for filing disclosures on your behalf or ensuring their accuracy or completeness.
4.6. No Legal or Financial Advice from My Sports ID Card: You acknowledge that My Sports ID Card is a technology platform and does not provide legal, tax, financial, or athletic eligibility advice. You are strongly advised to consult with independent legal counsel, financial advisors, and/or your institution’s compliance office regarding your specific NIL activities and obligations.
4.7. Consequences of Non-Compliance: My Sports ID Card reserves the right, in its sole discretion, to investigate, suspend, or terminate your account and remove any content or activity if we have reason to believe you are in violation of these Terms, our NIL Compliance Policy, or any applicable NIL laws or regulations. You acknowledge that non-compliance with NIL rules could result in severe consequences, including loss of athletic eligibility, scholarships, or legal penalties, for which My Sports ID Card is not responsible.
5.1. Your Content: You retain all ownership rights to the content you upload, post, or display on or through the Platform (“User Content”). By submitting User Content, you grant My Sports ID Card a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and My Sports ID Card’s (and its successors’ and affiliates’) business, including for promoting and redistributing part or all of the Platform (and derivative works thereof) in any media formats and through any media channels.
5.2. Representations and Warranties: You represent and warrant that your User Content and your activities on the Platform will not: * Infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy. * Violate any applicable law or regulation, including NIL laws, privacy laws (like COPPA), or laws regarding consumer protection, unfair competition, anti-discrimination, or false advertising. * Be fraudulent, false, misleading, or deceptive. * Be defamatory, obscene, pornographic, vulgar, or offensive. * Promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. * Be violent or threatening or promote violence or actions that are threatening to any person or entity. * Promote illegal or harmful activities or substances.
5.3. Prohibited Activities: You agree not to: * Use the Platform for any illegal purpose or in violation of any local, state, national, or international law. * Collect or store any personally identifiable information from the Platform from other users without their express permission. * Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity. * Engage in any unsolicited advertising or spamming. * Interfere with or disrupt the operation of the Platform or the servers or networks connected to the Platform. * Attempt to gain unauthorized access to any portion of the Platform, other accounts, computer systems, or networks connected to the Platform.
5.4. Content Moderation: My Sports ID Card reserves the right, but is not obligated, to monitor, review, remove, or edit User Content that we deem, in our sole discretion, to violate these Terms, our NIL Compliance Policy, or any applicable law.
6.1. Terms of Participation: Participation in the My Sports ID Card Fundraising Engine is subject to these Terms, including specific terms outlined on the Fundraising Engine section of our website. You agree to adhere to the revenue split models as described (e.g., Peer-to-Peer, Annual Licensing, Monthly Recurring) and understand that My Sports ID Card retains a portion of the card sale revenue for platform services.
6.2. Compliance with Fundraising Rules: Organizations and individuals participating in fundraising activities are responsible for ensuring their campaigns comply with all relevant laws and regulations regarding charitable solicitations, raffles, lotteries, and any other fundraising rules applicable in their jurisdiction.
6.3. Payouts: Payouts to fundraising organizations and sales representatives will be processed according to the schedules and terms outlined on the Platform and are subject to valid payment method details and compliance with all terms.
7.1. Fees: Certain features and services on the Platform may require payment of fees, including one-time activation fees, subscription fees, and commissions on sales (e.g., merchandise, tickets, live streams). All fees are clearly stated on our Pricing Page and within the Platform.
7.2. Payment Processing: We use third-party payment processors (e.g., Stripe) to handle all transactions. By making a payment, you agree to their terms and conditions. We do not store your full payment card details.
7.3. Subscriptions: If you opt for a subscription-based service, you agree to the recurring billing terms. Your subscription will automatically renew until you cancel it. You can manage or cancel your subscription through your account settings.
7.4. Refunds: All fees are generally non-refundable unless otherwise stated or required by law.
The Platform, including its design, text, graphics, images, logos, features, and underlying software, is owned by My Sports ID Card and is protected by copyright, trademark, and other intellectual property laws. Except for your User Content, you may not copy, modify, distribute, sell, or lease any part of our Platform or included software, nor may you reverse engineer or attempt to extract the source code of that software.
The Platform may integrate with or contain links to third-party websites, applications, or services (e.g., social media platforms, payment processors, merchandise fulfillment partners). My Sports ID Card does not endorse and is not responsible for the content, privacy policies, or practices of any third-party services. You access and use these third-party services at your own risk.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. MY SPORTS ID CARD DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY SPORTS ID CARD, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM, INCLUDING ANY DAMAGES RELATED TO NIL ACTIVITIES, ATHLETIC ELIGIBILITY, OR RECRUITMENT, EVEN IF MY SPORTS ID CARD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL MY SPORTS ID CARD’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO MY SPORTS ID CARD DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless My Sports ID Card, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:
13.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your State, e.g., Delaware] without regard to its conflict of law principles.
13.2. Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in [Your City, Your State] before one arbitrator. The arbitration shall be administered by [e.g., JAMS, American Arbitration Association] pursuant to its [e.g., Streamlined Arbitration Rules and Procedures]. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
13.3. Waiver of Class Action: You and My Sports ID Card agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Unless both you and My Sports ID Card agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
We may terminate or suspend your access to all or part of the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms, our Privacy Policy, or our NIL Compliance Policy. Upon termination, your right to use the Platform will immediately cease.
15.1. Entire Agreement: These Terms, together with the Privacy Policy and NIL Compliance Policy, constitute the entire agreement between you and My Sports ID Card regarding the use of the Platform.
15.2. Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.3. Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and My Sports ID Card’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
15.4. Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without My Sports ID Card’s prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. My Sports ID Card may assign or transfer these Terms, at its sole discretion, without restriction.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
