MY SPORTS ID CARD: DISPUTE RESOLUTION POLICY

  1. INTRODUCTION & OUR COMMITMENT

At My Sports ID Card (“My Sports ID Card,” “we,” “us,” or “our”), we are committed to providing a positive and fair experience for all users of our website, mobile applications, and all related services (the “Platform”). We understand that disagreements or issues may occasionally arise. This Dispute Resolution Policy outlines the process for resolving disputes between you and My Sports ID Card in an efficient, respectful, and cost-effective manner.

 

This policy is an integral part of our [Terms of Service]. By using our Platform, you agree to follow the procedures outlined herein for resolving any disputes with My Sports ID Card.

 

  1. SCOPE OF THIS POLICY

This policy applies to all disputes, claims, or controversies arising out of or relating to your use of the My Sports ID Card Platform, our services, these policies, or any aspect of your relationship with My Sports ID Card.

 

This policy does NOT cover:

  • Claims of copyright infringement, which are handled under our [Copyright / DMCA Policy].
  • My Sports ID Card’s internal enforcement actions related to violations of our [Acceptable Use Policy], [Community Guidelines], or [NIL Compliance Policy] (e.g., content removal, account suspension/termination), which are at our sole discretion.
  • Disputes between individual users on the Platform; such disputes should be resolved directly between the users involved, though our community guidelines provide reporting mechanisms for inappropriate behavior.
 
  1. INFORMAL RESOLUTION (OUR PREFERRED FIRST STEP)

We believe that most issues can be resolved quickly and to everyone’s satisfaction through direct communication. If you have a dispute or concern, we strongly encourage you to first contact our customer support team to attempt to resolve the matter informally.

 

How to Initiate Informal Resolution:

  • Email: Send an email detailing your concern to support@mysportsidcard.com.
  • Required Information: Please include your My Sports ID Card username/email, a clear description of the dispute, relevant dates, and any supporting documentation.

Our support team will review your issue and work with you in good faith to reach a mutually agreeable resolution. We aim to respond to all informal resolution requests within [e.g., 5-7 business days].

 

  1. FORMAL DISPUTE RESOLUTION PROCESS

If a dispute cannot be resolved informally through customer support, either you or My Sports ID Card may initiate a formal dispute resolution process as follows:

4.1. Notice of Dispute: If informal efforts are unsuccessful, the complaining Party must provide a written “Notice of Dispute” to the other Party.

  • To My Sports ID Card: All Notices of Dispute to My Sports ID Card must be sent by certified mail or reputable overnight courier to: My Sports ID Card Attn: Legal Department – Notice of Dispute. A copy may be sent via email to supoprt@mysportsidcard.com but formal delivery via mail/courier is required.
  • To You: If My Sports ID Card initiates a Notice of Dispute, it will be sent to the email address associated with your My Sports ID Card account.
 

The Notice of Dispute must include:

  • Your name and contact information (address, phone number, email).
  • Your My Sports ID Card username (if applicable).
  • A detailed description of the nature and basis of the dispute.
  • The specific relief you are seeking (what you want to achieve).
 

4.2. Good Faith Negotiations: Upon receipt of a Notice of Dispute, the Parties shall engage in good faith negotiations for a period of [e.g., thirty (30) days] from the date the Notice of Dispute is received. The goal is to resolve the dispute through direct communication and negotiation without resorting to arbitration or litigation.

 

4.3. Mandatory Binding Arbitration (Unless Small Claims): If the Parties are unable to resolve the dispute through good faith negotiations within the [e.g., 30-day] period, the dispute shall be exclusively and finally resolved by binding arbitration, as detailed in our [Terms of Service].

  • Arbitration Forum: The arbitration shall be administered by [e.g., JAMS, American Arbitration Association (AAA)] pursuant to its [e.g., Streamlined Arbitration Rules and Procedures] before a single arbitrator.
  • Location: The arbitration will take place in Stockton, California or a mutually agreed-upon location.
  • Arbitrator’s Authority: The arbitrator will have exclusive authority to grant motions dispositive of all or part of any claim. The arbitrator will have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the arbitral forum’s rules, and the Agreement (including the AUP, Privacy Policy, NIL Compliance Policy, and Community Guidelines). The arbitrator will issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded.
  • Final and Binding: The arbitrator’s award shall be final and binding on both Parties, and judgment on the award may be entered in any court having jurisdiction.
 

4.4. WAIVER OF CLASS ACTION AND JURY TRIAL: BY AGREEING TO THESE TERMS, YOU AND MY SPORTS ID CARD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. This means that unless both you and My Sports ID Card agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

 

4.5. Small Claims Court Exception: Notwithstanding the above, either Party may elect to pursue a dispute in a small claims court of competent jurisdiction if the dispute qualifies for such court and remains solely in such court.

 

  1. GOVERNING LAW

This Dispute Resolution Policy, and all disputes arising from it, shall be governed by and construed in accordance with the laws of the State of California without regard to its conflict of law principles.

 

  1. ARBITRATION COSTS

The payment of any filing, administrative, or arbitrator fees will be governed by the applicable arbitration rules. If the value of the relief sought is $10,000 or less, you may elect to have the arbitration conducted by telephone or based solely on written submissions, which election shall be binding on you and My Sports ID Card subject to the arbitrator’s discretion to require an in-person hearing.

 

  1. CONFIDENTIALITY

All aspects of the arbitration proceeding, including but not limited to the award of the arbitrator and compliance therewith, shall be strictly confidential. The Parties agree to maintain confidentiality unless otherwise required by law.

 

  1. CHANGES TO THIS POLICY

My Sports ID Card reserves the right to modify or update this Dispute Resolution Policy at any time. We will notify you of any material changes by posting the updated policy on our website. Your continued use of the Platform after such modifications constitutes your acceptance of the revised policy.
