My Sports ID Card (“the Platform”) is committed to empowering athletes of all levels to build their personal brands, monetize their Name, Image, and Likeness (NIL), and engage with their communities responsibly and compliantly. This NIL Compliance Policy outlines the principles, guidelines, and responsibilities for all users of the Platform, including athletes (youth, high school, college, and professional), coaches, agents, and organizations, to ensure adherence to relevant NIL regulations.

4.1. Personal Brand Only: NIL activities must involve the athlete’s individual name, image, and likeness. They cannot involve the intellectual property (logos, trademarks, uniforms, facilities) of their educational institution, team, or athletic association unless explicitly permitted by that institution or association through a separate, compliant agreement. Users are responsible for understanding their institution’s policies on the use of institutional marks.
4.2. Fair Market Value: Any compensation received for NIL activities must be for work actually performed and reflect fair market value for the services rendered.
4.3. Prohibited Activities/Categories: The Platform strictly prohibits NIL activities that promote or are associated with: * Gambling, sports betting, or casinos * Alcohol or tobacco products (including e-cigarettes/vaping) * Cannabis or illicit drugs * Adult entertainment or sexually explicit content * Weapons, firearms, or ammunition * Banned substances (as defined by athletic organizations like NCAA, USADA) * Hate speech, discrimination, or illegal activities.
4.4. Contractual Obligations: Users must ensure that any NIL agreements entered into via the Platform do not conflict with existing contracts they may have (e.g., scholarship agreements, team contracts, other NIL deals).

Transparency & Disclosure: While My Sports ID Card is not responsible for direct reporting to institutions, we encourage and facilitate users to comply with any disclosure requirements mandated by their state laws, NCAA, or their specific educational institution/athletic association. The Platform will provide tools (e.g., a disclosure log) to help users track and document their NIL activities for self-reporting purposes.
5.1. Youth Athletes (Under 13 years old) * Parental Consent (COPPA Compliance): All accounts for users under 13 must be created and managed by a parent or legal guardian. Verifiable parental consent will be obtained before any personal information is collected from or about a child, or before the child engages in any NIL-related activities. * Limited Functionality: Features that could lead to direct, unmoderated interaction with third parties or direct monetization will be restricted or require explicit parental approval for this age group. * Content Moderation: All content uploaded by or for youth athletes will undergo moderation to ensure age-appropriateness and safety. * Educational Focus: Emphasis for this age group is on building confidence, positive digital identity, and basic understanding of personal branding under adult supervision. Direct monetization is discouraged and heavily regulated.
5.2. High School Athletes (Ages 13 and up) * Varying State Laws: High school NIL rules vary significantly by state and local athletic associations (e.g., NFHS rules, state-specific high school athletic associations). Users are solely responsible for understanding and complying with the NIL laws and policies in their specific state and high school athletic association. My Sports ID Card provides general education but cannot provide state-specific legal advice. * Maintaining Amateur Status: High school athletes must understand that improper NIL activities could jeopardize their amateur status and future collegiate eligibility. * No Pay-to-Play for Recruitment: NIL deals for high school athletes cannot be used as an inducement to attend a particular high school or for athletic performance. * Parental/Guardian Involvement: While not always legally required for over 13, strong parental/guardian involvement is highly recommended for high school athletes engaging in NIL.
5.3. College Athletes (NCAA Student-Athletes) * NCAA Interim Policy & State Laws: College athletes must comply with the NCAA’s interim NIL policy (and any subsequent updates, including those arising from the House v. NCAA settlement impacting 2025-26), their specific state’s NIL law (if applicable), and their university/conference’s NIL policies. * Institutional Policies Precedence: University-specific NIL policies often supplement or supersede state law. Athletes must be aware of their institution’s rules regarding: * Disclosure requirements for NIL deals. * Prohibited categories of endorsements. * Use of university intellectual property (logos, uniforms, facilities). * Restrictions on timing of NIL activities (e.g., during official team activities). * Rules regarding “collectives” or third-party entities. * No Performance-Based Compensation: Compensation cannot be tied to athletic performance (e.g., points scored, games won) or participation in a specific sport. * No Recruiting Inducement: NIL deals cannot be used to induce enrollment at a particular institution or to transfer between institutions. * Professional Service Providers: Athletes may use professional service providers (agents, financial advisors, attorneys) for NIL activities, consistent with NCAA and state guidelines. My Sports ID Card does not act as an agent or financial advisor.
5.4. Professional Athletes, Coaches, and Agents * Contractual Review: Professional users are responsible for ensuring their NIL activities on the Platform comply with any professional contracts, league rules, or collective bargaining agreements they are subject to. * Multi-Profile Management: Agents and coaches utilizing multi-profile management features must ensure they have proper authorization and consent from each athlete they represent to manage their NIL profiles and activities. * Ethical Conduct: All professionals are expected to uphold the highest ethical standards in their dealings.
6.1. Education & Resources: * Provide an easily accessible NIL education module within the Platform for all users. * Offer general guidance on state NIL laws and NCAA policies (acknowledging these are subject to change and specific legal advice is recommended). * Publish blog posts and resources on best practices for athlete branding, financial literacy, and NIL compliance.
6.2. Platform Features for Compliance: * Design features to encourage compliant behavior (e.g., clear warnings when attempting to upload prohibited content, reminders about institutional IP). * Provide tools for users to track and potentially disclose their NIL activities, if required by their institutions. * Implement content moderation systems to identify and flag potentially non-compliant or inappropriate content.
6.3. Data Security & Privacy: * Maintain robust data security measures to protect user information, especially for minors, in accordance with COPPA and other relevant privacy laws. * Ensure transparency in data collection and usage as outlined in our Privacy Policy.
6.4. No Legal or Financial Advice: My Sports ID Card explicitly states that it does not provide legal, tax, or financial advice regarding NIL activities. Users are strongly encouraged to seek independent professional counsel (attorneys, financial advisors, tax experts) to ensure personal compliance.
6.5. Reporting & Enforcement: * Users can report suspected violations of this policy. * My Sports ID Card reserves the right to investigate reported violations and take appropriate action, including: * Warning the user. * Removing non-compliant content. * Suspending or terminating user accounts. * Reporting egregious violations to relevant authorities (e.g., NCAA, high school athletic associations, law enforcement) if required by law or deemed necessary to protect the integrity of the Platform or the safety of users.
