MY SPORTS ID CARD: COPYRIGHT / DMCA POLICY

  1. INTRODUCTION & COMMITMENT TO COPYRIGHT

My Sports ID Card (“My Sports ID Card,” “we,” “us,” or “our”) respects the intellectual property rights of others and is committed to complying with U.S. copyright law, including the Digital Millennium Copyright Act (“DMCA”).

 

This Copyright / DMCA Policy outlines our procedures for addressing claims of copyright infringement on our website, mobile applications, and all related services (the “Platform”). We reserve the right to remove any content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. We also reserve the right to terminate accounts of users who are found to be repeat infringers.

By using My Sports ID Card, you agree to abide by this policy, in addition to our [Terms of Service], [Acceptable Use Policy], [NIL Compliance Policy], and [Community Guidelines].

 

  1. REPORTING COPYRIGHT INFRINGEMENT (DMCA NOTIFICATION)

If you are a copyright owner or an agent authorized to act on behalf of one, and you believe that any content hosted on the My Sports ID Card Platform infringes your copyrighted work, you may submit a written DMCA Takedown Notification to our Designated Copyright Agent with the following information:

 

For a valid DMCA Takedown Notification to be effective, it must be a written communication that includes substantially the following:

  1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. (e.g., “My copyrighted photograph titled ‘Athlete in Motion – Series A, Photo 1’,” or “My copyrighted video titled ‘My Team’s 2024 Highlight Reel’.”)
  2. Identification of the Allegedly Infringing Material: Sufficient information to enable us to locate the material that you claim is infringing on the My Sports ID Card Platform. This should include the URL(s) or other specific location(s) where the material can be found. (e.g., “The infringing photo/video is located at https://www.mysportsidcard.com/profile/[username]/[contentID] or ‘on the profile of user [Username].'”)
  3. Contact Information: Your full legal name, mailing address, telephone number, and email address.
  4. Good Faith Belief Statement: A statement that you have a good faith belief that use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy & Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Important Note: Do not send other inquiries or information to our DMCA Agent. Only DMCA notifications should be sent to the designated agent. Sending materially false or misleading claims may result in legal liability.

  1. MY SPORTS ID CARD’S RESPONSE TO A VALID DMCA NOTICE

Upon receipt of a valid and complete DMCA Takedown Notification:

  • We will promptly remove or disable access to the material that is alleged to be infringing.
  • We will notify the user who posted the allegedly infringing material (“Uploader”) that the material has been removed or access disabled.
  • We will provide the Uploader with a copy of the DMCA Takedown Notification (with personal contact information redacted, except for the name of the copyright owner/agent) and inform them of their right to submit a Counter-Notification (as described below).
 
  1. COUNTER-NOTIFICATION (FOR USERS WHOSE CONTENT WAS REMOVED)

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to submit a written Counter-Notification to our Designated Copyright Agent.

For a valid Counter-Notification to be effective, it must be a written communication that includes substantially the following:

  • Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled, and the location on the My Sports ID Card Platform where the material appeared before it was removed or access was disabled.
  • Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which My Sports ID Card may be found), and that you will accept service of process from the person who provided the original DMCA Takedown Notification or an agent of such person.
  • Sworn Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Physical or Electronic Signature: Your physical or electronic signature.

Please send your complete Counter-Notification to our Designated Copyright Agent at the address/email provided in Section 2.

 

  1. MY SPORTS ID CARD’S RESPONSE TO A VALID COUNTER-NOTIFICATION

Upon receipt of a valid Counter-Notification:

  • We will promptly provide the complaining copyright owner with a copy of the Counter-Notification.
  • We will inform the copyright owner that we will replace the removed material or cease disabling access to it within ten (10) to fourteen (14) business days following receipt of the Counter-Notification, unless our Designated Copyright Agent first receives notice from the copyright owner that they have filed an action seeking a court order to restrain the Uploader from engaging in infringing activity related to the material on the Platform.
  • If we do not receive notice of such a legal action within the specified timeframe, we may, at our sole discretion, reinstate the removed material.
 
  1. REPEAT INFRINGER POLICY

My Sports ID Card reserves the right to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat copyright infringers. My Sports ID Card will consider circumstances such as the number of valid DMCA Takedown Notifications received, the severity of the infringement, and the user’s overall conduct on the Platform.
